Terms & conditions for photography services

These Terms and Conditions apply to all photography services offered and sold by:

Hereinafter referred to as “the Photographer”, “we”, “us”, or “our”.
The person or business purchasing a photography service is referred to as “the Client”, “you”, or “your”.
By booking and purchasing a photography service through our website, you confirm that you have read, understood and accepted these Terms and Conditions.
1. Scope of the Agreement
These Terms and Conditions apply to all photography services offered by the Photographer unless otherwise expressly agreed in writing.
The specific details of the photography service purchased by the Client, including the type of session, price, duration, number of delivered images, included services, location, estimated delivery time and any other service-specific details, are stated in the description of the selected service on the website at the time of booking.
The service description applicable at the time of purchase forms an integral part of the agreement between the Client and the Photographer.
If there is a conflict between these Terms and Conditions and the specific description of a purchased service, the service-specific description shall apply to matters relating specifically to that service.
2. Booking and Formation of the Agreement
Photography sessions are booked through the Photographer's website using the available online booking system.
The Client selects an available date and time and pays the full price of the selected service at the time of booking.
Once payment has been successfully completed, the Client will receive a booking confirmation.
The agreement is formed when the Photographer confirms the booking, subject to the availability provisions set out in Section 3.
The Client is responsible for ensuring that all information provided during booking is accurate and complete.
3. Availability and Booking Errors
The Photographer uses an online calendar and booking system to display available appointment times.
Although reasonable efforts are made to keep the booking calendar accurate and up to date, technical errors, synchronisation problems, double bookings or administrative errors may occasionally result in a time being displayed as available when it is not.
If the Photographer discovers that a booked time is unavailable due to such an error, the Photographer will inform the Client as soon as reasonably possible.
The Photographer will offer the Client one or more alternative available dates or times.
If no suitable alternative can be agreed, the Photographer may cancel the booking and the Client will receive a full refund of all payments made for the cancelled session.
Except where liability cannot legally be excluded or limited, the Photographer is not responsible for indirect losses or costs incurred by the Client as a result of a booking error, including third-party expenses or arrangements made in connection with the planned session.
4. Prices and Payment
All prices are stated in NOK and include VAT where applicable.
The full price of the selected photography service must be paid at the time of booking unless otherwise expressly stated in the description of the relevant service.
The Client is responsible for any additional fees arising from optional purchases, including additional images, unless otherwise stated.
Unless otherwise specified in the relevant service description, additional images are available for purchase at a price of:
250 NOK per additional image.
The Photographer is not obliged to begin additional work or deliver additional images until payment for those additional services has been received.
5. Cancellation by the Client
If the Client wishes to cancel a booked photography session, the Client must notify the Photographer by email.
The following cancellation policy applies:
More than 6 weeks before the scheduled session
The Client is entitled to a 100% refund of the amount paid.
Between 6 weeks and 2 weeks before the scheduled session
The Client is entitled to a 75% refund of the amount paid.
The Photographer retains 25% of the booking price.
Less than 2 weeks before the scheduled session
The Client is not entitled to a refund.
This cancellation policy applies unless mandatory law provides the Client with greater rights.
A cancellation is considered received when the Photographer receives the Client's cancellation email.
6. Rescheduling
The Client may request to reschedule a photography session by contacting the Photographer by email.
Rescheduling is not automatic and is subject to the Photographer's availability.
Unless otherwise agreed in writing:
a booking may be rescheduled a maximum of two times;
the Client must contact the Photographer by email to request a new date;
the Photographer cannot guarantee that a particular requested date or time will be available;
the rescheduled session must take place within one month of the original session date.
The two-rescheduling limit applies to rescheduling requested because of circumstances relating to the Client.
If the session cannot be completed within the applicable time period because the Client has exhausted the permitted rescheduling opportunities or is unable to attend available alternative dates, the booking may be treated as cancelled and the cancellation terms in Section 5 may apply.
The Photographer may agree to additional rescheduling at their sole discretion.
7. Weather and Outdoor Sessions
For outdoor photography sessions, weather conditions may affect whether a session can reasonably or safely be completed.
The Photographer will determine whether weather conditions are suitable for the planned photography session, taking into account factors such as heavy rain, strong wind, unsafe conditions, lighting conditions and other relevant circumstances.
If the Photographer determines that the conditions are unsuitable, the Photographer may postpone the session and offer an alternative date.
The Photographer will make reasonable efforts to find a suitable alternative date.
The rescheduling limits in Section 6 do not apply where the Photographer is responsible for the need to reschedule.
If the session cannot reasonably be completed due to weather conditions and no suitable alternative date can be agreed, the parties will discuss an appropriate solution based on the circumstances.
Nothing in these Terms and Conditions limits any rights the Client may have under mandatory law.
8. Cancellation or Rescheduling by the Photographer
The Photographer may need to cancel or reschedule a session due to circumstances including, but not limited to:
illness;
emergency situations;
unsafe weather conditions;
unexpected technical or equipment problems;
booking errors or double bookings;
circumstances outside the Photographer's reasonable control.
Where reasonably possible, the Photographer will offer the Client an alternative date.
If the Photographer cannot perform the agreed service and the Client does not wish to accept an alternative date, the Client will receive a refund of the amount paid for the affected service.
9. Late Arrival
The duration of the photography session is based on the scheduled booking time.
If the Client arrives late, the session will normally end at the originally scheduled finishing time.
For example, if a one-hour session is booked and the Client arrives 20 minutes late, the Photographer may provide approximately 40 minutes of photography.
The Photographer may extend the session if time and scheduling allow, but is under no obligation to do so.
An extension may only be provided if the Photographer does not have another scheduled work commitment immediately after the session.
Late arrival does not automatically entitle the Client to a partial refund, extension or additional photography time.
10. Failure to Attend
If the Client fails to attend the scheduled session without arranging an approved rescheduling or cancellation in accordance with these Terms and Conditions, the booking may be treated as cancelled by the Client.
In such cases, the applicable cancellation terms in Section 5 apply.
11. Session Participants
The Client must provide accurate information about the expected number of people participating in the session.
The Client must inform the Photographer in advance if the number of participants differs materially from the number originally expected or if the session involves a group, family, employees, children or other participants.
The Photographer may refuse or modify a session if the actual circumstances differ significantly from the information provided at booking and this affects the planned service.
The Client is responsible for ensuring that all participants have been informed about the photography session and its practical arrangements.
12. Children and Minors
Photography involving a person under the age of 18 requires the involvement or authorisation of a parent or legal guardian where required.
The person booking the session is responsible for ensuring that the Photographer has the necessary permission for the minor to participate.
The Photographer may request confirmation of parental or legal guardian permission before or during the session.
The Photographer may refuse to photograph a minor if appropriate consent or authorisation cannot reasonably be confirmed.
Any separate consent regarding public or marketing use of a minor's image must be handled separately and in accordance with applicable law.
13. Image Selection
After the photography session, the Photographer will provide the Client with a private online gallery containing images available for selection.
The Client must select the number of images included in the purchased service within 30 days of receiving access to the selection gallery.
The Client may purchase additional images where this option is available.
Unless otherwise stated for the relevant service, additional images cost 250 NOK per image.
If the Client does not select the included images within the 30-day selection period, the Photographer may select the included number of images on the Client's behalf.
The Photographer's selection will be considered final for the purpose of completing the agreed service.
Unselected images are not included in the Client's purchase and will not be delivered unless separately agreed.
The Client may not download, screenshot, reproduce, distribute, publish or otherwise use unpurchased or unselected images without the Photographer's permission.
14. Image Editing
The Photographer determines the artistic and technical style of the final images.
The Client will receive professionally edited images selected in accordance with the purchased service.
The Photographer does not normally provide RAW files, unedited files or working files unless expressly agreed in writing.
The final images will be edited according to the Photographer's professional style and artistic judgement.
15. Delivery
Unless otherwise stated in the description of the relevant service, final edited images will be delivered digitally within approximately four weeks.
Delivery times may vary in exceptional circumstances, including illness, technical problems, high workload or circumstances outside the Photographer's reasonable control.
The Photographer will make reasonable efforts to inform the Client if a significant delay is expected.
Only digital files are included unless printed products or other physical products are expressly included in the purchased service.
16. Online Galleries and File Storage
Private online galleries will remain available for a minimum of three months, unless otherwise stated.
The Client is responsible for downloading and safely storing all delivered files.
The Photographer may retain copies of delivered images after delivery, but does not guarantee permanent, unlimited or indefinite file storage for the Client.
The Client should therefore maintain their own backup copies.
17. Copyright
The Photographer retains copyright and other intellectual property rights in all photographs created during the session, subject to applicable law.
Copyright ownership does not prevent the Client from using the delivered images in accordance with the licence granted under these Terms and Conditions.
The Client does not acquire copyright ownership of the photographs unless expressly agreed in writing.
18. Licence Granted to the Client
Upon full payment, the Client receives a non-exclusive licence to use the final delivered images.
The Client may use delivered images for:
personal use;
social media;
websites;
portfolios;
business promotion;
marketing;
advertising;
printed materials;
public relations;
other lawful purposes connected with the Client's personal or business activities.
A business Client may provide delivered images to employees, contractors, graphic designers or marketing agencies where this is reasonably necessary for the Client's own business use.
Such third parties may not acquire independent ownership or an unrestricted right to use the images for purposes unrelated to the Client.
19. Permitted and Prohibited Editing by the Client
The Client may:
crop images;
adjust image proportions or aspect ratios;
resize images;
make technical adaptations necessary for different formats or platforms.
The Client may not, without the Photographer's prior written permission:
apply filters;
change colours or colour grading;
retouch the images;
alter facial or body features;
use artificial intelligence to materially alter the appearance of the photograph or the people depicted;
otherwise modify the Photographer's editing or artistic style.
The Client remains responsible for ensuring that any third party using the images on the Client's behalf follows these restrictions.
20. Public Use of Images by the Photographer
The Photographer does not require the Client to agree to marketing or portfolio use of their images in order to purchase or receive the photography service.
The Photographer may contact the Client after the session to ask whether the Client is willing to allow specific images to be used for purposes such as:
portfolio display;
the Photographer's website;
social media;
advertising;
printed promotional materials;
professional publications or other promotional purposes.
Any such permission will be requested separately from the purchase agreement.
Where consent or other authorisation is required for the public use of an image, the Photographer will not rely on the Client's acceptance of these Terms and Conditions as a blanket marketing consent.
The Photographer's use of photographs is also subject to applicable law concerning copyright, commissioned portraits and the right to one's own image.
21. Client Responsibility for Participants
Where multiple adults participate in a photography session, the person making the booking may arrange the session on behalf of the group.
However, the booking Client cannot automatically grant marketing or public-use permission on behalf of other adult participants.
Where the Photographer wishes to publicly use images containing other identifiable participants, any required consent or authorisation will be handled separately.
22. Photographer's Professional Judgement
The Client acknowledges that photography involves artistic judgement.
The Photographer retains discretion regarding:
composition;
posing;
lighting;
image selection;
editing;
artistic style.
The Photographer does not guarantee that every image captured during a session will be delivered.
The number of final delivered images will correspond to the purchased service and any additional images purchased by the Client.
23. Client Conduct and Safety
The Client and participants must behave in a manner that allows the session to be conducted safely and professionally.
The Photographer may suspend or terminate a session if a participant behaves in a threatening, abusive, unsafe or seriously disruptive manner.
If the session cannot be completed because of the conduct of the Client or a participant, the Photographer may retain payment to the extent permitted by applicable law.
24. Liability
The Photographer will perform the photography services with reasonable care and professional skill.
The Photographer is not responsible for circumstances outside the Photographer's reasonable control, including force majeure events, sudden illness, unexpected technical failures despite reasonable precautions, unsafe conditions or other unforeseeable circumstances.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.
25. Complaints
If the Client believes that there is a problem with the photography service, the Client should contact the Photographer as soon as reasonably possible.
Complaints should be submitted in writing to:

The Photographer will review the complaint and respond within a reasonable period.
Nothing in these Terms and Conditions limits the Client's statutory consumer rights.
26. Personal Data
The Photographer processes personal data in accordance with applicable privacy and data protection laws.
Further information about how personal data is collected and processed is available in the Photographer's Privacy Policy.
27. Changes to These Terms and Conditions
The Photographer may update these Terms and Conditions from time to time.
The version published on the website at the time of the Client's booking will normally apply to that booking unless mandatory law requires otherwise.
28. Governing Law
These Terms and Conditions are governed by Norwegian law.
Mandatory consumer protection rules that apply to the Client are not affected by this choice of law.
